Terms and refunds

These terms apply when you buy a book pass for ChapterReady at acx.nimblepanda.co.uk. ChapterReady is run by NimblePanda Ltd, registered in England and Wales, company number 17122751, registered office Grange Road, Barnton, CW8 4PE. You can reach us at hello@nimblepanda.co.uk.

1. What you're buying

You buy a book pass. It lets you download fixed files for one audiobook: up to 15 hours of finished audio, within 90 days of buying it.

Prices are shown in pounds sterling and are the total you pay. Payment is taken by Stripe when you buy. If we change our prices, passes you've already bought are not affected.

2. Our promise: it passes, or you get your money back

If a file you fixed with ChapterReady doesn't meet ACX's technical audio requirements, we'll fix it for you, and if we can't, we'll refund your book pass in full.

To claim, email hello@nimblepanda.co.uk within 30 days of buying the pass. Include:

ACX's technical requirements means loudness (RMS), peak level, noise floor, room tone at the start and end of the file, MP3 format and bit rate, sample rate and maximum file length.

The promise doesn't cover:

When a refund is due, we pay it to the card you used within 14 days of agreeing it. A refunded pass is cancelled.

3. Your right to cancel

A book pass is digital content. When you buy, you ask us to make your pass available straight away. You can cancel within 14 days for a full refund as long as you haven't downloaded any fixed files. Once you download a fixed file, you agree that your 14-day right to cancel ends. This doesn't affect the promise in section 2 or your other legal rights.

4. Files you send us

ChapterReady processes your audio inside your browser, so we never receive it unless you choose to send it to us under section 2. If you do, we use it only to fix it for you, we don't share it with anyone, and we delete our copies within 30 days of closing your request. You keep all rights in your recordings. We claim none.

5. Using ChapterReady

Only process recordings you have the right to use. ChapterReady runs in current versions of Chrome, Edge, Firefox and Safari on a laptop or desktop computer. Very long files may not work on computers with little memory; if that happens, split the file and try again.

ChapterReady isn't part of, affiliated with or endorsed by ACX, Audible or Amazon. ACX sets its own requirements and can change them, and a person at ACX reviews every book.

6. Our responsibility to you

If we break these terms, we're responsible for loss or damage you suffer that was a foreseeable result. We aren't responsible for business losses, such as lost royalties or sales, and our total responsibility to you is limited to the amount you paid for the pass concerned. Nothing in these terms limits responsibility that can't be limited by law, or your legal rights as a consumer.

7. The law that applies

These terms are governed by the law of England and Wales. If you live in Scotland or Northern Ireland, you can also bring a claim in your local courts.
